POLICIES
Effective date: July 26, 2026
Important: This is a business policy draft for publication and customer use. It should be reviewed by a qualified West Virginia attorney before final publication.
1. General Purchase Policy
BHB Furniture sells new, previously owned, refinished, restored, and one-of-a-kind furniture and home decor. Previously owned pieces may show age-related characteristics, prior repairs, natural material variation, minor surface irregularities, or other signs consistent with their history.
BHB Furniture makes reasonable efforts to provide accurate descriptions, current photographs, measurements, material information when known, and disclosure of known material defects. Customers are responsible for reviewing the listing, photographs, dimensions, condition notes, delivery requirements, and this policy before purchase.
2. Order Cancellations and Refunds
Cancellations within 48 hours
A customer may request cancellation within 48 hours after purchase, provided the item has not been picked up, delivery has not begun, the item has not been altered at the customer’s request, custom work has not started, and special materials or hardware have not been ordered.
Approved refunds will be returned to the original payment method. Processing time may depend on the payment provider or financial institution.
Final sale after the cancellation period
Because most BHB Furniture pieces are unique and are removed from sale once purchased, purchases generally become final after the 24-hour cancellation period. A change of preference, color mismatch, failure to measure the intended space, or inability to move the furniture into the home does not qualify as a product defect.
Custom work and customer-requested alterations
Deposits and payments for custom sourcing, refinishing, or customer-requested alterations become nonrefundable once design approval is given, labor begins, materials or hardware are purchased, or a furniture piece is acquired specifically for the customer. Any refundable amount will be determined after subtracting committed labor, materials, hardware, transportation, acquisition, and other project costs.
Damaged, incorrect, or materially misrepresented items
Customers should inspect the item at pickup or delivery whenever reasonably possible. Claims involving delivery damage, an incorrect item, a significant undisclosed defect, or a material difference from the written product description must be reported within 48 hours after pickup or delivery.
• The customer’s name and order information
• A written description of the issue
• Clear photographs or video
• Photographs of packaging or the delivery area when relevant
BHB Furniture may inspect the item before approving a remedy. Depending on the circumstances, the remedy may include repair, touch-up service, a mutually agreed replacement, partial refund, or full refund with return of the item.
Refund exclusions
• Normal characteristics of used or refinished furniture
• Disclosed imperfections or age-related wear
• Minor color differences caused by lighting, screens, photography, or surrounding colors
• Customer measurement errors, buyer’s remorse, or a change of preference
• Damage after pickup or delivery, including improper moving, use, cleaning, storage, or modification
• Failure to follow care, weight, or safety instructions
Nothing in this policy limits rights or remedies that cannot legally be waived.
3. Holds, Deposits, and Storage
An item is not reserved until the required deposit or full payment is received and confirmed.
The maximum hold period is 30 calendar days from the date of payment or deposit unless BHB Furniture agrees to a different period in writing.
• The customer must complete payment and arrange pickup or delivery within the 30-day hold period.
• If the customer does not complete the transaction or accept the item within 30 days, BHB Furniture may cancel the reservation, retain any nonrefundable deposit to offset lost selling time and committed costs, and return the item to active inventory.
• Any extension must be approved in writing before the hold period expires.
BHB Furniture will make reasonable efforts to contact the customer before cancelling a reservation.
4. Curbside Delivery
Standard service
BHB Furniture offers curbside delivery at an approved delivery address, unless a different method is agreed to in writing before purchase. Delivery availability is subject to route, distance, schedule, vehicle capacity, weather, road conditions, staffing, and the size and weight of the furniture.
Curbside delivery means the item will be placed at a reasonably accessible exterior location such as the driveway, curb, garage entrance, loading area, or main building entrance.
Curbside delivery does not include
• Carrying furniture inside the home or building
• Room-of-choice placement
• Stairs, elevators, long interior carries, or difficult indoor turns
• Assembly, installation, wall mounting, or wall anchoring
• Removing doors, trim, railings, windows, or existing furniture
• Disconnection or movement of appliances
Scheduling and delays
Delivery dates and estimated arrival windows must be confirmed. Delivery windows are estimates and are not guaranteed appointment times. BHB Furniture will make reasonable efforts to communicate material delays.
For Internet or telephone orders, BHB Furniture will follow applicable requirements concerning promised delivery times, delay notices, customer consent to delays, cancellations, and prompt refunds for undelivered merchandise.
5. Customer Delivery Responsibilities
Before delivery, the customer must:
• Confirm the correct address and contact information
• Measure the item, driveway, gate, entrance, and intended path
• Arrange adequate people and equipment to move the item indoors after curbside delivery
• Clear vehicles, pets, children, snow, ice, debris, and other obstacles from the delivery area
• Obtain permission from a landlord, building manager, association, or loading dock when required
• Have an authorized adult present to receive and inspect the item
BHB Furniture may refuse or stop delivery when the location appears unsafe or inaccessible, including severe weather, untreated ice, aggressive animals, blocked access, unstable surfaces, inadequate lighting, or other hazardous conditions.
A failed or refused delivery caused by an incorrect address, customer absence, unsafe access, failure to prepare the site, or inaccurate information may require an additional delivery fee before rescheduling.
6. Customer Pickup
Customers choosing pickup are responsible for providing a suitable vehicle, adequate assistance, moving blankets, straps, and safe securing equipment. The customer must confirm that the item fits the vehicle and can be transported safely.
BHB Furniture may decline to load or assist when the vehicle, lifting method, staffing, or securing plan appears unsafe. Risk of loss or damage transfers to the customer after the item has been loaded into or onto the customer’s vehicle, except to the extent caused by BHB Furniture’s negligence.
7. Inspection and Acceptance
The customer or authorized recipient should inspect the furniture and the delivery area before the delivery vehicle departs. The customer may be asked to acknowledge receipt of the correct item, apparent condition, and completion of curbside delivery.
Acknowledging delivery does not waive a claim for concealed damage that could not reasonably have been identified at delivery, provided the issue is reported within 24 hours.
8. Furniture Safety and Wall Anchoring
Previously owned and refinished furniture may not meet the construction methods, safety standards, or performance expectations of newly manufactured furniture. Furniture must be used only for its intended purpose.
• Do not allow children to climb, hang, or play on furniture.
• Do not open multiple loaded drawers at the same time.
• Do not overload drawers, shelves, tops, or cabinets.
• Tall, narrow, or top-heavy furniture should be anchored to a suitable wall.
BHB Furniture does not provide wall anchoring, wall mounting, or structural installation services. The customer is solely responsible for selecting appropriate anchoring hardware and having the furniture properly anchored by a qualified person when necessary.
Furniture that becomes loose, unstable, damaged, or unsafe should be removed from use until inspected and repaired.
9. Liability Disclaimer
To the fullest extent permitted by law, BHB Furniture is not responsible for injury, loss, or damage caused by misuse, unintended use, overloading, climbing, tipping, failure to anchor furniture, improper installation, improper transportation after customer pickup, unauthorized repairs or modifications, ordinary wear and tear, or exposure to unsuitable moisture, heat, sunlight, chemicals, pests, or storage conditions.
BHB Furniture is not responsible for damage caused by inaccurate measurements, incomplete access information, or unsafe instructions provided by the customer.
BHB Furniture is not responsible for pre-existing damage to driveways, sidewalks, landscaping, doors, walls, flooring, stairways, railings, elevators, or other property. Customers should identify fragile, recently repaired, unusually valuable, or vulnerable property before delivery begins.
Nothing in this policy excludes or limits liability for gross negligence, willful misconduct, fraud, or any liability that cannot legally be excluded or limited.
10. Delivery-Related Property Damage
A claim that BHB Furniture caused property damage during delivery must be reported as soon as reasonably possible and no later than 24 hours after delivery.
The customer must preserve the condition of the area and provide photographs, video, estimates, or other reasonable documentation. BHB Furniture must be given a reasonable opportunity to inspect and evaluate the reported damage before repairs are authorized, except when immediate action is necessary to prevent further damage or address a safety hazard.
BHB Furniture may decline reimbursement for unauthorized repairs that prevent reasonable verification of the claim, unless delaying the work would have been unsafe or caused additional damage.
11. Photographs and Design Visualizations
Product photographs are intended to represent the furniture as accurately as reasonably possible. Actual color may vary because of lighting, camera settings, screen calibration, surrounding colors, paint application, and natural material variation.
Digitally created or edited MVD images are design visualizations. They represent the intended design direction and do not guarantee exact color, texture, dimensions, grain pattern, hardware position, or final appearance.
12. Policy Updates and Applicable Rights
BHB Furniture may update this policy from time to time. The version in effect when the customer places an order generally applies to that transaction unless the parties agree otherwise in writing.
If one part of this policy is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. This policy does not eliminate consumer rights provided by applicable federal, state, or local law.
